MOR Non-Profit Research and Education Image Use Agreement and Request

User Agreement

  • Digital images may be cropped for layout, but all other alterations (bleeding, overprinting, coloration, etc.) must be given prior approval from Museum of the Rockies (hereafter MOR). Images scanned in 2022 and forward will not be altered by MOR staff (e.g., removal of scratches or spots of dust, sizing for printing, etc.). If permission to adjust an image is granted, the details of the adjustment must appear on or in immediate proximity to the reproduction, in the section of the publication devoted to acknowledgements, or as prescribed in the conditions agreed upon by MOR and the applicant.
  • Reproduction and publication of MOR images shall not be used to show or imply MOR endorses any product or enterprise, concurs with the opinions expressed, or confirms the accuracy of any text accompanying the image.
  • Permission is granted for one-time use only. Any subsequent use of a digital image requires the written permission of MOR. In authorizing use of an image, MOR does not surrender its own right to publish it, or to grant permission to others to do so.
  • MOR reserves the right to request a printer’s proof or sample for approval prior to publication or reproduction and reserves the right to revoke permission based on the proof or sample. MOR reserves the right to deny use, adaptation, or reproduction of its images if the purpose is deemed to conflict with MOR’s mission or policies. We reserve the right to refuse to provide images to requesters who have not complied with our policies.
  • The Copyright Law of the United States (Title 17, U.S. Code) governs the making of photocopies or other reproductions of copyrighted material. Any reproduction or publication of materials to which MOR holds copyright must bear a copyright notice as prescribed by this law. The credit line “Museum of the Rockies, [object ID number], [additional descriptive information as necessary, e.g., photographer, writer]” must appear on or in immediate proximity to the reproduction, in the section of the publication devoted to acknowledgements, or as prescribed in the conditions agreed upon by MOR and the applicant.
  • If copyright is held outside of MOR, the applicant must independently obtain the permission of the copyright holder. “Museum of the Rockies” should still be credited as the holder of and provider of the image. All responsibility for possible copyright infringement and invasion of privacy arising from use of images is assumed by the user.
  • User agrees to indemnify and hold harmless MOR and its staff from and against all claims made by any person or organization asserting to be the owner of copyright. In the event of litigation, the user agrees to pay all attorney fees for MOR.
  • This agreement only authorizes the use of images for publication, research, education, non-profit, or personal use. It does not authorize the applicant to reproduce the image in advertising, promotion, film, television, or to mass produce the image as unbound material. Any commercial use other than publication requires a separate application/agreement and fees. Please contact MOR’s Cultural History Registrar and Collections Manager to inquire.
